Yamaha Rhino Rollover

Beginning in about 2003, talk began centering on what has become known as the Yamaha Rhino rollover problem. Despite advertisements associated with the Yamaha Rhino that stated it was a safe ATV, an ever increasing number of people were being seriously injured and even killed as the result of Yamaha Rhino rollover accidents. As of this point in time, there have been approximately 50 reported deaths and many individuals who have been injured seriously as the result of a Yamaha Rhino rollover accident.
The Yamaha Rhino Rollover Problem and the Yamaha Rhino Recall
Over the course of about six years the Yamaha Rhino rollover problem continued with more and more people being seriously injured and even being killed. Eventually, at the beginning of 2009, the manufacturer finally called for a recall of certain models of the Yamaha Rhino.
An argument is now being made that the Yamaha Rhino rollover recall was not initiated in a timely manner. There is mounting evidence to suggest that the manufacturer knew quite some time ago that there were design flaws in this ATV that resulted in what is not being called the Yamaha Rhino rollover.
On the other hand, if for some reason the company really did not know about the Yamaha Rhino rollover issue that arose from a design defect there is another line of argumentation that suggests that even if the company did not know of the issue concerning the Yamaha Rhino rollover the company should have reasonably known about the problem.
Your Rights Following a Yamaha Rhino Rollover Accident
If you have been injured as the result of a Yamaha Rhino rollover accident, or if you have a family member that has been injured or even killed as the result of a Yamaha Rhino rollover accident, you do have certain legal rights that you need to understand and pay attention to at this time.
You need to understand that the manufacturer has an obligation to deal with any known design defects appropriately and with all deliberate speed. Additionally, the manufacturer has an obligation to deal with any such design defects that it reasonably should have known of. There is mounting evidence that Yamaha did know of or should have known of the design defects that caused the Yamaha Rhino rollover accidents and did not take action in an appropriate manner to protect consumers.
