DePuy Hip Recall Concerns

In August 2010 two of the popular hip replacement systems – the Depuy ASR XL Acetabular System and the ASR Hip Resurfacing System – were recalled due to a high failure rate. Experts have estimated that the systems have a 12 to 13 percent failure rate which is much too high for medical standards. What this means is that 12 to 13 percent of all patients will need to undergo a second or revision surgery within five years.

DePuy Hip Lawsuit

Most patients would not have accepted the DePuy hip replacement knowing the failure rate was so high and knowing the serious complications involved in the surgery. There are several other types of replacement systems out there. However, the problem is that patients were not told about these concerns and it was not until August 2010 that the recall came out informing patients about the high failure rate. Because of this, the Johnson and Johnson Company may be held responsible for this medical mistreatment.

DePuy Hip Replacement Patients

Many people are suffering from the effects of this DePuy hip recall. While some of the patients are retired and thus do not need to work every day, others are not. Some are single parents trying to keep food on the table for their kids. Some are struggling with a mortgage and need to work in order to pay the bills. Most cannot afford to not only take time off to get the second surgery completed, but also pay the additional expenses involved including rehabilitation costs, surgery expenses and childcare fees. Even those that are not working are not able to enjoy their retirement with the daily pain and suffering experienced due to the faulty DePuy hip replacement.

Costs and Concerns, DePuy Hip Recall

If you are one of the 11,500 people experiencing pain and the need for a second surgery, then you could be looking at several unexpected costs including:

- Childcare, nanny, care takers costs
- Surgery, rehabilitation and medication costs
- Blood tests and other diagnostic testing
- Loss of income if unable to work
- Emotional and physical suffering

You have already gone through one operation and made it through – now you may have to go through it all over again. You could be looking at months of recovery and even more pain, not to mention the risk of infection or serious complications during the surgery.

DePuy Hip Recall Warnings

Experts have predicted that there will be several lawsuits filed against the makers of DePuy Hip Replacement systems after the recall last year of two of their most popular systems. Patients across the United States are outraged at the recent news that the DePuy ASR XL Acetabular System and the ASR Hip Resurfacing System have been recalled due to a high failure rate.

DePuy Hip Recall Failures

It has been estimated that approximately 1 in 8 patients treated with either system will need a replacement or revision surgery within the next five years. Because of this, Johnson and Johnson, the manufacturers of the DePuy hip replacement systems, have sent out letters to all patients who have received treatment in an effort to stop any lawsuits from happening.
It is important to familiarize yourself with the various DePuy hip recall side effects and recent events in order to remain up to date on what is happening. If you have been treated with a DePuy hip replacement within the last five years, then you could easily be one of the patients facing problems. Even if you have not experienced any pain or problems yet, you are not out of the clear.
DePuy Hip Complications

Some of the complications of DePuy hip replacements that you may be looking at include:

• Pain in the hip, groin or lower leg after the surgery has taken place
• Metal staining, metallosis and bone staining due to the metal on metal implant
• Clicking, clanking or crunching sounds from the device
• Problems with physical activity including running, walking and bending down
• Infection, swelling
• Tissue, muscle and nerve damage

What is At Stake?

If you are one of the thousands of patients that are faced with a failed system, then you could be risking a lot more than you think.

• A second or revision surgery – once again you will need to go under the knife and go through the lengthy recovery process
• The need to rely on other people during your recovery and rehabilitation period
• Loss of income if you are once again unable to work
• Emotional suffering and mental anguish of feeling incapable again
• Additional specialty medical equipment such as a specialty bath, toilet seat and cane for walking
• Physical pain both before and after the second surgery
• The chance of metallosis, or metal staining
• Tissue, nerve and muscle damage due to the failed system
• Medical costs including blood work, surgery and rehabilitation fees

DePuy Hip Recall Compensation

Because of the recent recall of two of the most popular DePuy hip replacement systems, the Johnson and Johnson Company are doing everything in their power to avoid a string of lawsuits. It has been estimated that approximately 1 in 8 patients treated with either system will need a replacement or revision surgery within the next five years. This is simply too high and, because of this, the systems have been recalled.

DePuy Hip Recall Letter

Furthermore, because of this, Johnson and Johnson, the manufacturers of the DePuy hip replacement systems, have sent out letters to all patients who have received treatment in an effort to stop any lawsuits from happening. If you have received a letter regarding your DePuy hip replacement and the DePuy hip recall, it is important that you speak to a lawyer about what this means. By signing the letter you could be waving your rights to compensation in the future.

DePuy Hip Recall Payment

The DePuy hip recall is for the DePuy ASR XL Acetabular System or ASR Hip Resurfacing System. If you have been fitted with either of these systems within the last five years you may have been contacted by the Johnson and Johnson Company or by DePuy offering information about these devices and the recall in place. The letter may have informed you about some of the evidence and news regarding the system as well as signs to be on the lookout for.

Johnson and Johnson may offer you compensation for your losses if you have needed to undergo a second or revision surgery. However, by signing any paperwork handed to you, you could be signing away your rights to legal counsel and additional compensation in the future.

DePuy Hip Recall Costs

With a 1 in 8 failure rate there is a good chance that you could be next. Compensation provided by the DePuy and Johnson and Johnson company does not cover many of the costs associated with a second or revision surgery including blood tests needed to check for metal staining and diagnostic tests needed.
Consider all the different costs you could be faced with if you need a second or revision surgery:

• Loss of income if unable to work again
• Rehabilitation fees
• Medical and pain relief
• Surgery expenses
• Costs to have someone take care of you while you recover
• Cost of a nanny or maid to take care of your children and house while you are recovering
• Cost to rent or buy additional devices to help you with your recovery including a specialized toilet seat, bath tub and cane
• Costs of medical care if infection occurs
• Emotional and physical pain endured

Most of these additional DePuy hip recall costs will not be covered through the standard compensation offered through Johnson and Johnson. Consider this when you receive your letter.

DePuy hip recall lawsuits have been filed across the country by several hundreds of patients experiencing pain and the need for a second revision surgery. Some of the lawyers involved with the DePuy hip recall lawsuits are scheduled to meet in late January 2011 to discuss the various cases with the federal judge.

DePuy Hip Recall Lawyers to Meet

It was decided last month that all lawsuits filed in any federal court against the Johnson and Johnson Company, the manufacturers of the DePuy hip replacement systems, be transferred to the US District Court.

A conference has been set up for DePuy hip recall attorneys to meet with Judge Katz who will be handling some of the lawsuits filed. The conference will take place in West Palm Beach, Florida and will offer a chance for DePuy hip recall attorneys to discuss the hot issues at hand and what will happen next.

DePuy Hip Recall Lawsuits

There are more than 100 cases filed against the Johnson and Johnson Company regarding the DePuy hip recall that Judge Katz will be looking into and presiding over. However, it is expected that thousands of additonal cases will be involved in the litigation. DePuy hip recall lawyers across the country are meeting with clients and investigating new claims for patients who have received defective implants in the last five years.

DePuy Hip Recall Concerns

There are a number of complaints that will be raised during the conference surrounding the neglect and medical manufacturing errors involved in the DePuy hip replacement systems. The two systems that have recalled – the DePuy ASR XL Acetabular and the DePuy ASR Hip Resurfacing Systems- have been given a high failure rate with 11,5000 of the 93,000 people expected to need a replacement or revision surgery within five years of the operation. This equates to a 13 percent failure rate which is much too high no matter how you look at it.
In addition to the high failure rate, there are also issues with metal staining, nerve and tissue damage, infection and severe pain and suffering caused by the DePuy hip systems. The metal on metal implants has also been known to cause inflammatory reactions and can lead to bone loss.

DePuy Hip Recall Metallosis

January 19, 2011 by US Drug Recall

Two of the DePuy hip replacement systems – the DePuy ASR XL Acetabular and the DePuy ASR Hip Resurfacing Systems- - have recently been recalled due to a high failure rate associated with them. In addition to many patients needing to undergo a second or revision surgery within five years of treatment, the DePuy replacement systems have also been linked to another serious complication called metallosis.

Metallosis Defined

Metallosis is caused by an abrasion of metal components in your body. The DePuy hip replacement systems are metal on metal which can cause metal staining and other complications. If the metal on metal system is not properly fitted, which has been the case for many patients with faulty DePuy hip replacements, then the metal can break off into your blood stream causing metal contamination, or metallosis.

Metallosis comes with several serious complications including:

  • Pseudo tumors around the implant location
  • Elevated rate of cobalt and chromium in the blood stream
  • Black tissue around the area
  • Metal sensitivity

Your doctor will be able to perform blood tests and additional diagnostic tests to determine whether you are at risk for metallosis. If so, then you may need a replacement surgery to correct the problem before it is too late.

DePuy Metal Contamination Study

English researchers have recently put out a study in which 3.4 percent of patients experienced adverse reactions to metallic particles due to the metal on metal systems failing inside the body. Dealing with metal contamination can make a second or revision surgery even more complicated than it already is. You could be faced with months of recovery and pain not to mention the financial implications of such a surgery.

DePuy Hip Pain

Additonal DePuy hip problems to be aware of include:

  • Infection and swelling from the implant area
  • Dislocation of the implant
  • Pain and problems walking and with other psychical activity even after the surgery and recovery
  • Damage to the nerves, tissues and muscles near the implant area

It has been estimated that around 11,500 people will need a revision surgery due to the DePuy hip failure within the next five years. If you have been treated with a DePuy hip replacement, you could be one of these people.

Since the DePuy hip recall last year, several hundreds of people have spoken up about the pain and complications they have suffered through. Several others have filed lawsuits against the Johnson and Johnson Company for their product liability and malpractice.

DePuy Hip Recall

On August 24th 2010, DePuy Orthopedic released a recall of 93,000 hip replacement systems after several months’ speculation on the malfunctioning of the product. DePuy Orthopedics confirmed that they recalled the systems due to “higher than expected” incidences of repeat surgeries.

They have recalled two of their popular systems – the ASR XL Acetabular System, a hip socket used in traditional hip replacement, as well as the ASR Hip Resurfacing System, a partial hip replacement that involves placing a metal cap on the ball of the femur.

If you or someone you love has had a hip replacement in the last five years, then it is a good idea to speak to your physician about what type of system was put in. There is a high possibility that you used a DePuy hip replacement system that has been recalled due to a high failure rate.

DePuy Hip Revision Surgery Complications

The recall comes after several years of controversy surrounding the product. The hip replacement system was approved in 2005 but starting receiving complaints in 2007. By 2008 the number of complaints had doubled and by 2009, the complaints have tripled. It was in March 2010 that DePuy first suggested that the system was malfunctioning with a formal recall notice put through in August 2010.

DePuy ASR Hip Replacement Recall

Hip replacements should last for at least 15 years; however, DePuy hip replacement systems have been known to fail after just a few months to five years. A study by the National Joint Registry of England and Wales confirmed what many doctors and physicians have suspected – that the failure rate of DePuy hip replacement systems are far too high.

12-13 Percent Failure Rate DePuy Hip Replacement Systems

Recent data from the National Joint Registry of England and Wales showed that 12-13 percent of patients who received the recalled system will need a repeat surgery within 5 years. This means that around 11,600 patients will need to have their hip replacement fixed by 2014.  This equates to 1 in every 8 surgeries that are considered a total failure.

The study also confirmed that many of the patients experienced severe pain and other symptoms with the DePuy hip replacement system including inflammation, tissue damage and infection. The complications arose due to the metal on metal device as well as poor manufacturing of the system. DePuy Orthopedic have cited component loosing and component misalignment as two of the many reasons why this system is considered a failure and has been recalled.

August 2010 marked the end of the five year road for DePuy Orthopedics, Inc. ASR Hip Replacement Systems and ASR XL Acetabular System, two of its hip replacement products. The DePuy hip replacement systems have been used in patients all over the world. A shocking amount of patients have experienced problems and the need for a repeat surgery within five years.

MHRA DePuy Hip Recall Alert

Medical Device Alert issued this recall notice in September 2010:

“The manufacturer has informed the MHRA that it is recalling all ASR hip replacement implants. Further background information on this recall is detailed in the manufacturer’s Field Safety Notice dated 24 August 2010. The manufacturer previously issued a Field Safety Notice on 08 March 2010.

The manufacturer has now determined that the revision rate for all devices in the ASR systems at five years is higher than expected across the entire size range and so is recalling all ASR system hip replacement implants. Following consultation with our orthopedic experts we are updating the advice provided in Medical Device Alert (MDA/2010/044) to ensure appropriate follow-up is considered for all patients already implanted with these hip replacement implants.”

If you have received a DePuy ASR hip replacement between 2005 and 2009 and are experiencing pain and problems with your hip, then you may have been implanted with a defective product. It is important that you speak to an experienced DePuy hip recall lawyer about your next plan of action.

DePuy Hip Recall Warning

DePuy Orthopedics has confirmed that the product could be considered defective and have warned patients to be on the lookout for:

- component loosening
- component misalignment
- infection
- fracture of the bone
- dislocation
- metal sensitivity
- pain
- increased metal ion levels in the blood
- bone staining
- necrosis
- swelling
- nerve damage
- tissue damage
- muscle damage

DePuy Hip Replacement Lawsuit Timeline

The August 2010 recall follows a series of complications with the DePuy ASR systems. The DePuy ASR replacement systems first hit the United States in 2005. In 2010, DePuy Orthopedics announced that they would be taking their system off the shelves due to declining sales but did not mention anything about the failure rate of the systems. However, in March 2010, the New York Times reported that DePuy issued its first warning to doctors and patients about the high early failure rate. Six months later the official recall came.

In June 2010 the first lawsuit against DePuy Orthopedics was filed, claiming that the DePuy ASR hip replacement was defectively designed, that DePuy knew that there were problems but allowed the manufacturing and distribution to go on anyway. It is expected several more lawsuits will follow in the upcoming months.
